Delta 8 THC in Texas

Delta-8 THC is one of the cannabinoids that is getting the most attention right now. It is a similar version of delta-9-THC that can make you feel a mild to moderate high. In fact, many people are calling it "The New THC." And even that isn't the best part. Delta-8-THC is the link between hemp, which is legal under federal law, and marijuana, which is illegal under federal law. It is a high that is legal under federal law in many U.S. states. But in the United States, legal highs, whether they come from cannabis or not, are strictly regulated or outlawed. Will delta-8 suffer the same fate? Will Texas see delta-8 prohibition?

Is delta-8 legal in Texas?

Delta-8 THC  in Texas right now because a judge in Travis County temporarily stopped the state from making it a controlled substance. Under state law, you can buy and sell delta-8 THC made from hemp that has less than 0.3% THC. You can buy, own, and use products made from hemp that contain delta-8 without getting in trouble with Texan law enforcement. The DEA issued an interim final rule in 2020 about the legal status of delta-8-THC. The DEA thinks that delta-8-THC could be "synthetically-derived" and a controlled substance, which would make it illegal at the federal level.

Hemp plants don't have a lot of delta-8 on their own. It requires manufacturers to convert CBD into delta-8. Some people think that this change makes delta-8 a synthetic, while others don't agree. Delta-8 could be made illegal in the future if it is seen as a synthetic version of THC.

Does Texas allow Delta-8 THC?

Delta-8 THC made from hemp is legal in Texas right now. All cannabinoids, terpenes, flavonoids, and isomers that come from hemp are currently legal to sell, distribute, own, and use. Check out the latest news above.

How Texas conforms to federal law

In 2018, the Agriculture Improvement Act (Farm Bill) was signed into law by the Trump administration. This made it legal to grow, make, sell, own, and use hemp and products made from hemp. It also took THCA, THCV, and delta-8 THC, which are all found in hemp, off the list of substances that can't be bought or sold. Before, the federal government put all cannabis, including hemp, on a list called Schedule I, which made it illegal. The Farm Bill basically sets hemp and marijuana apart from each other (medical cannabis).

How to tell the difference between hemp and marijuana

This difference is important, and it has to do with how much THC is in the plant. If it has more than 0.3% THC, it is still a controlled substance. Hemp has less than 0.3% THC on average, while marijuana has between 15% and 20% THC on average. The legal limit is 0.3 percent, so hemp is also legal. Since hemp is legal under federal law, all compounds made from hemp plants (except THC) are also legal. This includes delta 8. As was already said, Texas follows this federal decision and lets delta-8 THC be sold, given away, owned, and used according to state law.
