Is delta-8 legal in Texas?

it a controlled substance. Under state law, you can buy and sell delta-8 THC
made from hemp that has less than 0.3% THC. You can buy, own, and use products

enforcement. The DEA issued an interim final rule in 2020 about the legal
status of delta-8-THC. The DEA thinks that delta-8-THC could be
"synthetically-derived" and a controlled substance, which would make
it illegal at the federal level.
Hemp plants don't have a lot of
delta-8 on their own. It requires manufacturers to convert CBD into delta-8.
Some people think that this change makes delta-8 a synthetic, while others
don't agree. Delta-8 could be made illegal in the future if it is seen as a
synthetic version of THC.

How Texas conforms to federal law
In 2018, the Agriculture
Improvement Act (Farm Bill) was signed into law by the Trump administration.
This made it legal to grow, make, sell, own, and use hemp and products made
from hemp. It also took THCA, THCV, and delta-8 THC, which are all found in
hemp, off the list of substances that can't be bought or sold. Before, the
federal government put all cannabis, including hemp, on a list called Schedule
I, which made it illegal. The Farm Bill basically sets hemp and marijuana apart
from each other (medical cannabis).
How to tell the difference between hemp and marijuana
This difference is important, and
it has to do with how much THC is in the plant. If it has more than 0.3% THC,
it is still a controlled substance. Hemp has less than 0.3% THC on average,
while marijuana has between 15% and 20% THC on average. The legal limit is 0.3
percent, so hemp is also legal. Since hemp is legal under federal law, all
compounds made from hemp plants (except THC) are also legal. This includes
delta 8. As was already said, Texas follows this federal decision and lets
delta-8 THC be sold, given away, owned, and used according to state law.
